14. Dispute Resolution

Please read this section carefully. It affects your legal rights. Any dispute arising from these Terms and Conditions or your use of our website will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be seated in Harris County, Texas, and judgment on the award may be entered in any court of competent jurisdiction. An arbitrator, not a court or jury, will decide all disputes. You and Air Quality Express waive the right to a jury trial and the right to bring or participate in any class, collective, consolidated, or representative action. Either party may instead bring an individual claim in small claims court. If the class action waiver is found unenforceable, this Section 14 is void in its entirety and disputes will proceed in the state or federal courts located in Harris County, Texas, with the jury waiver remaining in effect.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Air Quality Express regarding your use of our website.

17. Text Messaging (SMS)

Consent. When you provide your mobile number to Air Quality Express, by submitting a form on this website, booking online, or giving it to our team by phone, you agree that we may contact you by text message at that number regarding your inquiry, estimate, appointment, service, and billing. Some of these messages are sent by an automated system, including our AI scheduling assistant, which can hold a two way text conversation with you about booking or rescheduling.

What we send. Appointment confirmations and reminders, technician arrival notifications, estimate and invoice links, scheduling and rescheduling, service follow up, and replies to questions you send us. We do not send promotional or marketing text messages.

Frequency. Message frequency varies based on your service activity. Most customers receive a small number of messages tied to a single job.

Cost. Message and data rates may apply. Air Quality Express does not charge for text messages, but your mobile carrier may.

Opting out. Reply STOP to any message to stop receiving texts from us. You will get one confirmation message and then no further texts. Opting out of texts does not cancel your appointment or affect your service, and we will reach you by phone or email instead. Reply START to resume.

Help. Reply HELP to any message, call us at (832) 781-0105, or email service@airqualitytech.com.

Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.

Consent is not a condition of purchase. You do not have to agree to receive text messages in order to buy any service from Air Quality Express.
